Three municipalities in Navarre are accused of setting different prices for their public swimming pools

Several Navarrese municipalities They charge different prices in their public pools according to user registration, a measure that has drawn criticism from the FACUA. The consumer organization urged municipalities to change their ordinances, arguing that This practice violates the principle of equality in access to public services.

FACUA-Consumers in Action addressed the municipal councils of Navarrese towns of Noáin, Beriáin and Valle de Aranguren that they modify their ordinances to put an end to discrimination in the prices of their public swimming pools, which maintain different prices depending on whether the user is registered in the municipality or not.

The association, through its territorial delegation in Navarre, learned that in Noain The monthly payment for the annual subscription for your swimming pools is a lower euro for those registered, while in Bériain There is an increase of up to 50% in fees for unregistered people.

For his part, Aranguren Valley It maintains prices that can go up to double if the user is not registered in the municipality: a registered adult pays 159 euros per year, while if the user is not registered, the cancellation fees amount to 320 euros.

In its writings to town halls, FACUA highlights that article 189 of the Foral Law 6/1990, of July 2, of the local administration of Navarre, stipulates that “all citizens who meet the requirements established in each case They will have the same right to use local public services“, without there being any discrimination in their provision.”

Thus, taxing the provision of a public service solely based on whether or not the user is registered in the municipality represents a blatant violation of citizenship.

In this sense, the Supreme Court in its judgment 1065/2023of July 20, in which it specifies that “the municipality cannot establish quantitative differences in the tariff for the use of municipal frontons, swimming pools and sports facilities, taking into account whether or not the users are registered in the municipality , because they the registration is not erected, in this case, on a reasonable and objective criterion for the purposes of justifying them.

For all these reasons, FACUA urges the municipal councils of Noáin, Beriáin and the Aranguren Valley to modify its municipal ordinances to put an end to the price difference for public swimming pools based on user registration.
