The spokesperson for Vox at the city hall of the capital, Javier Ortega Smith, will finally ask the Superior Court of Justice of Madrid (TSJM) provisional execution of the judgment which cancels the low emission zones (ZBE) of capital
Two months ago, the resolution of the TSJM which canceled the ZBE was known, on the basis of an appeal presented by the municipal group Vox, note a “gap” regarding the economic impact report in the municipal Sustainable Mobility ordinance.
A few hours after hearing the judgment, Ortega Smith announced that the municipal group would study the provisional execution of the sentence, while the mayor, José Luis Martínez-Almeida, announced that the municipal government was working on the processing another Mobility prescription because “it would be irresponsible” not to do so, regardless of the presentation of an appeal to the Supreme Court.
Finally it will be this Thursday when Ortega Smith will go to the TSJM to request provisional execution of the sentence. He will do this with the support of the national legal coordinator of the party, Marta Castro, and the rest of the councilors of the municipal group.
“Demonstrates an inadequacy”
The TSJM, on the other hand, accepted Vox’s arguments concerning “the notorious insufficiency of the reports prior to the approval of the order”, in particular the “manifests an insufficiency” in the economic impact report before approval of the order. In short, the Court lacks “an adequate assessment of the balance of benefits and costs and the possibility of adopting less restrictive measures of equivalent effect or which could produce a discriminatory effect for the most economically vulnerable groups”.
The judgment alludes, as indicated in Vox’s appeal, to the impact of the measures on thousands of professional vehicles. considers it particularly important that the situation of business groups with less economic capacity for the renewal of the vehicle, such as the self-employed, micro-enterprises or SMEs, but he emphasizes that the reports prior to the approval of the ordinance do not refer to this issue either.
Provisional execution
Ortega Smith has already put forward the possibility of requesting provisional execution of the sentence because he considers “that from now on until the appeal is resolved, unnecessary harm would continue to be caused to the population of Madrid”. The municipal leader of Vox declared that “They cannot subjugate the people of Madrid for two or three years until this appeal is resolved.”
“We know that, thanks to this decision, many Madrid residents will be able to continue their lives without the burden of having to leave on January 1, 2025. more than a million vehicles registered in Madrid that they were going to have to scrap, something intolerable,” continued the Vox spokesperson.
