In total, 195 foreign graduates are waiting for the Supreme Court to rule on the preventive suspension of the transfer to the Basque Country of the approval of foreign diplomas. The court decreed the judgment in July this year, just months after the political agreement for the transfer, and left these professionals in no man’s land as most of them had to cancel the approval files initiated by the Spanish government to begin with. the new process in Euskadi and now these files are blocked. The Minister of Science, Universities and Innovation, Juan Ignacio Pérez Iglesias, detailed in a parliamentary response that a total of 195 files are paralyzed, which corresponds to 136 requests for approval and 59 for declaration of equivalence.

Questioned by the parliamentarian of EH Bildu, Ander Goikoetxea, the advisor underlines that “the Basque Government has continued to work internally on the study of the files, while awaiting the resolution of the Supreme Court”, but he recognizes that it does not can do nothing but wait for the decision. decision of the court, which is “the competent body to decide on preventive suspension”. “We must wait to know the answer before adopting any measure in this direction,” he emphasizes.

Pérez Iglesias indicates that the Basque Government contacted each of the people concerned to explain “what the situation was” two days after the Supreme Court’s ruling, dated July 24. But he insists the department can do no more than wait for the judicial resolution on jurisdiction.

The contentious and administrative chamber of the Supreme Court provisionally suspended the state decree which transferred to Euskadi the power to approve foreign diplomas. The appeal was filed by the Interprofessional Union of the Community of Madrid. The preventive suspension of the decree left pending all requests already submitted to the Basque administration.

This transfer was part of the package agreed with Urkullu as Lehendakari in which the management of Cercanías and the reception of migrants were also transferred. The Basque Government attached great importance to this transfer due to the need to have non-Community professionals available for Osakidetza staff. In fact, the majority of applicants for certification have qualifications related to healthcare fields.

The regional validations were going to be fully valid not only in Euskadi but also in Spain and throughout the European Union and the court considers that “all precautions must be taken, in particular those aimed at ensuring that homogeneous guidelines are respected in the ” ” On the other hand, we cannot hide the importance that, for the general public interest, which the State must preserve, the guarantee of homogeneous action in matter throughout Spain, because it transcends the purely educational dimension, already of vital importance for the individual, and projects itself onto the no less relevant exercise of professions which require a certain university degree,” he adds.

The biggest problem currently for these 195 candidates is that in order to present the application for approval in the Euskadi, they had to first cancel the one filed in Madrid, which would force them to start from scratch in case their application in the Euskadi was definitively canceled . In August, they took to the streets to ask the sub-delegation of the central government of Bilbao that “bureaucratic decisions do not ruin their lives” and to emphasize that Euskadi needs professionals like them from the social and health sector .
