Fagan Aliyev, born in 2000 in the Babek district of the Nakhchivan Autonomous Republic, injured his wife Zumrud Babayeva (full name provided – ed.) during a dispute arising from a family conflict.
According to Demokrat.az, the incident took place on May 5 this year in the town of Babek.
The perpetrator of the incident, Fagan, was charged under Article 128 of the Criminal Code (intentional damage to health).
Fagan, who testified as a defendant in the criminal case, pleaded guilty to the charges against him.
He noted that he works in Nakhchivan:
“On the day of the incident, I slept after returning from my shift at 8 a.m. I woke up around noon. I wanted to eat because I was hungry. That’s why I called my wife Zumrud. At that time, the door of the room I was sleeping in was closed. I went to the kitchen because the child was crying and when I opened the door I saw that Zumrüd was talking on the phone.”
The accused said that in the meantime Zumrud hid the phone:
“I asked Zumrüd for her phone. Instead of giving it to me, she said, ‘Why don’t you believe me? ‘ I saw one of them writing obscene messages to Zumrüd and I said, ‘I’m fine, you’re fine. ‘ ‘I’m fooling myself. ‘ I called my mother-in-law and my parents. Zumrud’s mother replied that her daughter was fine. After that, I told them to leave the girl and called the police. After that, the police officers came and took us to the office.
The defendant said that there had been many arguments between him and Zumrüd before, the main reason being his mother-in-law’s interference in his family affairs:
“I have recently taken steps to reconcile with Zumrud. My relatives and I also went to her house, but my mother-in-law kicked us out the door. I looked for the person Zumrud was corresponding with on Instagram. That person said that she had a relationship with Zumrud for a long time.”
According to Zumrüd, who testified as a victim in the case, she married Fagan in 2021:
“It’s almost as if I didn’t have a normal relationship with him, I didn’t divorce him for my son. On the day of the incident, I was preparing food in the kitchen. At that time, I didn’t hear Fagan’s voice because the volume of the TV in the kitchen was loud. I corresponded with other people, deliberately left the phone on, and asked Fagan to watch it. Because Fagan repeatedly cheated on me with women. He said that Fagan would divorce me in two months. I told Fagan that “I will do it if you don’t stop” on the social network to get revenge on Fagan. I wanted him to experience what Fagan did to me. “
The victim said that on the day of the incident, Fagan looked at the phone and saw the messages:
“That’s why he hit me. I complain about Fagan. Even if my mother gives me permission, I won’t reconcile with him.”
The case was heard in the Babek District Court. According to the court’s verdict, Fagan was sentenced to seven months of correctional labor. It was determined that the correctional labor sentence will be counted from the moment the sentence comes into force, and that the defendant will serve his sentence at his main place of work. The execution of the sentence was entrusted to the Babek District Execution and Probation Department of the Ministry of Justice of the Nakhchivan Autonomous Republic.
