Report backs Prohens claiming 3.7 million

The government of the Balearic Islands, when it was presided over by the socialist Francine Armengolhired the company Soluciones de Gestión SL without being able to do so legally. This company is considered the epicenter of the corruption plot investigated in the Koldo case.

This is what a report from the Consell Consultiu concludes. In this 38-page document, to which EL ESPAÑOL has had access, the main consultative body of the Government of the Islands is shown. in favor of canceling this contractsigned in May 2020 and intended for the supply of masks.

For what reason? “For having incurred cause of nullity provided for in Article 39.2 a) of the Public Procurement Act (LCSP), taking into account the company’s lack of capacity to contract the supply that is the subject of said contract and the lack of adequate technical solvency to carry it out,” explains the text.

This conclusion now confirms that the current Balearic government, already chaired by Marga Prohens (PP), can claim the full amount of the contract, 3.7 million euros. This is what the popular leader intends to do, according to sources close to EL ESPAÑOL.

“It has also been proven that the activity which was part of the company’s corporate purpose [Soluciones de Gestión SL] That didn’t fit either. to achieve the purpose of the contract,” the report states.

In fact, Soluciones de Gestión SL was not dedicated to the supply of medical supplies, which is what the Armengol government had hired it for at the beginning of the Covid-19 pandemic. In fact, the masks that arrived in the Balearic Islands did not meet the required requirements and were stored by the Administration. They were never used and have already expired.

On the other hand, Soluciones de Gestión SL is in bankruptcy proceedings, which complicates the already complicated restitution of the 3.7 million euros. This company received more than 30 million euros in two contracts awarded by the Ministry of Transport, then headed by José Luis Ábalos. The order was the same: the supply of sanitary masks.

However, a few weeks later, he was also chosen for this purpose by the governments of the Canary Islands and the Balearic Islands, when both were in the hands of the PSOE. The first was led the current minister Ángel Víctor TorresThe second, Francina Armengol, who is now president of the Congress of Deputies.

The call Koldo case takes the name of Koldo Garcia Izaguirrewho was Ábalos’ main advisor when he was Minister of Transport. As published by EL ESPAÑOL, andThe former director general of the Balearic Health Service (IB-Salut) Manuel Palomino acknowledged that purchased 1.4 million masks with Management Solutions after speaking with Koldo García.

However, the Consell Consultiu report maintains that this award was made under the emergency procedure, due to the exceptional health situation caused by the pandemic.

“But this procedural flexibility in emergency treatments does not mean that, in these cases, the substantive requirements and guarantees contained in the contractual legislation (…), relating to the capacity to contract with the public sector, of natural or legal persons, and the requirement for holders of a public contract that their services are included in their corporate purpose, requirements that (…) the successful bidder of this contract does not comply with”, indicates the report on Social Security Solutions. SL Management.
