To better understand the change in strategy of Víctor de Aldama, in preventive detention for a case of tax fraud in hydrocarbons and accused in the “Koldo case”, a little context is necessary. Aldama faces up to twenty years in prison. Collaborating with the justice system can mean a reduction of up to two degrees and half of the detention time. He has just changed lawyers to the former judge of the National Court, José Antonio Choclán, who presents himself on his website as a “criminal expert, expert in reaching agreements”; This is due to their appreciable experience in providing negotiation services to footballers -Cristiano Ronaldo…-, artists -Imanol Arias…-, bankers -Ángel Ron…-, businessmen -Francisco Correa, David Marjaliza… – or politicians – Cristina Cifuentes or Rita Barberá.
Surely advised by his new lawyer and after negotiating with the prosecution, Aldama appeared before the judge to engage in cooperation which could bring him significant criminal profits if it proves effective. He did so with a thoughtful and structured statement with a clear objective: to multiply the value of his collaboration to maximize his criminal benefit performance. In other words, Koldo and José Luis Ábalos are already considered politically and criminally dead at this point, especially after the devastating UCO report. Something more had to be offered.
To generate this extra, Aldama detonated something very similar to a cluster bomb: a single projectile or device carries a number of small bombs of varying destructive capabilities that it releases when it hits its target. Leaving aside the specific accusations, the fundamental mechanism behind Aldama’s statement is quite similar. There is a credible and evidence-rich summary – the “Koldo affair” – which Aldama used to publish a series of potentially explosive complaints and rumors, taking extreme caution not to directly incriminate himself in new criminal acts that are not already in the base scenario summary.
The tactical advantage of the cluster bomb is that using a single bomb releases several dozen others in a single launch. The tactical advantage sought by Aldama seems similar: by incriminating himself in a report in which he was already deeply incriminated, he drops several media and political bombshells that he does not need to prove. It will be enough for him to provide the proof that he must surely prove the veracity and functioning of the corrupt plot of the “Koldo affair” so that everything else at least benefits from the doubt, when it does not directly receive the presumption of veracity. All he has to do is collaborate to support the “Koldo case” with the rest of his complaints and accusations. Herein lies the true destructive power of the Aldama Confession. The PSOE and Pedro Sánchez are wrong if they believe that the lack of evidence that Aldama can present protects them. It is indeed relevant for criminal evidentiary purposes. For political and media reasons, this barely matters. Aldama just needs to present the evidence that he surely has on his business relations with Koldo and company to detonate the media and political bombs of his latest complaints in clusters and promote his collaboration. They shouldn’t even include criminal acts. A simple encounter is enough to trigger a scandal.
He doesn’t have to prove he corrupted you. All he needs to do is say that he knows you. Each piece of evidence that he will surely present to prove his collaboration in the “Koldo case” and obtain the expected benefits, will activate the cluster of remaining political and media bombs again and again. It’s war. Normally, it is not enough to wish for peace.
