Judge rejects as excessive and “prospective” the PSOE’s request to investigate the accounts and affairs of Ayuso’s boyfriend

Judge Inmaculada Iglesias rejected the PSOE and Más Madrid’s request to investigate more companies and all banking movements, from 2019 to 2022, Alberto Gonzalez Amadorboyfriend of the president of the Community of Madrid, Isabel Díaz Ayuso.

This is stated in an order dated July 31 and signed by the president of the capital’s investigating court number 19, which is investigating González Amador for two alleged crimes of tax fraud.

On June 24, Ayuso’s partner had to go, for the second time, to testify before the courts of the Plaza de Castilla. And once again, the judge suspended his interrogation. On this occasion, due to the request of the PSOE and Más Madrid that more procedures be carried out before its declaration.

Now, in agreement with the prosecution, the judge rejects it. And he explains that some of the demands of the two parties, which exercise the popular accusation, “can be considered prospective because there is no evidence of crimes other than those which are the subject of this procedure.”

Similarly, “many” requests regarding the two popular accusations “could be unnecessary,” because these are facts about which the respondents can be questioned when recording their statements. And of course, they would excessively delay the investigation of the case.

Specifically, among other issues, the PSOE and Más Madrid have requested that the Court, through the Judicial Neutral Point, carry out a “patrimonial investigation” into González Amador and the other people under investigation.

Both parties also demanded to know the movements of their bank accounts between 2019 and 2022, as well as all the “accounting documentation of the independent activity” of Ayuso’s boyfriend and the house purchases and participations in companies made by him. The PSOE and Más Madrid have also proposed to be summoned to testify 20 witnesses.

In turn, they asked the Court to request information from seven companies about their business relationships with the people under investigation. And they asked the judge to seek cooperation from the authorities of Mexico, United States and Panama so that these countries issue the “commercial, fiscal and accounting” documentation of the different companies.

“The conclusion is that the practice of interested procedures for accusations would last for years“, preventing the rapid prosecution of the facts which were the subject of this procedure: two tax offences in competition with the offence of lying”, concludes the magistrate in the order, dated more than a month ago but unknown until now.

In fact, these are the facts that are currently being investigated in this case (two alleged crimes against the Public Treasury for the payment of corporate tax in 2020 and 2021 and one for falsification of a commercial document). In fact, at the beginning of the investigation, González Amador’s lawyer proposed that his client could acknowledge them and reach an agreement with the prosecution.

Specifically, Ayuso’s boyfriend was willing to accept eight months in prison and pay 520,000 euros to avoid a trial for tax fraud. However, the PSOE and Más Madrid, in the document in which they requested the aforementioned procedure, also attributed to González Amador the crimes of unfair administration, commercial corruption and false accounting.
