The PP reproduced on the social network X, formerly Twitter, the words of the deputy secretary general of the PSOE, First Vice President of the Government and Minister of Finance, María Jesús Monterocelebrating that the Constitutional Court (TC) has partially admitted the appeals for amparo of ten of the former socialist leaders of the Junta of Andalusia convicted by the specific procedure for financing fraudulent labor regulation files (ERE) financed by the Junta of Andalusia, annulling their convictions and ordering the Court of Seville to issue new convictions on the basis of this supreme instance.
In more detail, María Jesús Montero applauded at an event in Seville that The TC “knew the truth of a false case, set up to overthrow and exhaust” to the Andalusian PSOE as the party leading the Junta of Andalusia, in reference to the role of the PP-A as a popular accusation in this case; which in its entirety, in its multiple separate parts, covers situations such as dozens of people taking early retirement under the ERE promoted by companies in which these people did not work or arbitrary aid to companies whose illegality has been recognized by different beneficiaries who have accepted reduced sentences by agreement in accordance with the prosecution and the rest of the accusations.
He also warned that the PP-A “wants to achieve by undemocratic means what it was unable to achieve in the elections”; to which the PP responded on the social network, the PSOE said.
Specifically, the Constitutional Court, with a majority of seven judges in favor and four against, partially admitted the appeals for amparo of ten of the former socialist leaders of the Junta de Andalucía convicted by the Court of Seville for embezzlement and in other cases also for embezzlement, in the specific procedure of regional financing of fraudulent ERE and arbitrary and unprecedented aid to companies.
In view of this case, the TC annulled the conviction of the Seville Court against former socialist leaders of the Junta such as the former regional presidents Manuel Chaves and José Antonio Griñán, the former socialist minister and former Minister of Economy of Andalusia Magdalena Álvarez, the former socialist councilor of Employment Antonio Fernández, the former socialist Minister of Finance Carmen Martínez Aguayo, the former socialist Minister of Innovation Francisco Vallejo or the former vice-minister of Innovation Jesús María Rodríguez Román.
In this sense, the Constitutional Court orders the First Section of the Court to return the judicial procedure to the moment before the sentence was issued and to issue a new judgment taking into account the legal bases incorporated by the court in the case; such as that “it cannot be considered that participation in the approval of the draft finance laws and their approval as draft laws can be qualified as resolutions falling within the administrative matter”.
